S.M.A.R.T. MERGER INFORMATION :

celebrate the S.M.A.R.T. Merger between UTU and SMWIA. People from both unions were on hand to meet and greet members. It
was a good time for all who attended. All members of our local committee were there as well.

We are not S.M.A.R.T. yet. But the courts have ruled to dismiss the injuction blocking
the merger. We will keep you updated on new developments as they occur.

This is the conclusion of the 58 page ruling on the Temporary Restraining Order ( TRO ) issued against
the S.M.A.R.T. Merger:
V. Conclusion
I therefore believe that while the district court had subject matter jurisdiction to consider the plaintiffs’
complaint, the district court, for the reasons given, should not have issued the injunction as a matter of law, because there
was no evidence of any discrimination by the officers and directors of UTU, and, furthermore, the district court abused its
discretion in issuing a preliminary injunction on the record presented to that court. The decision of the district court,
therefore, should be reversed,the judgment vacated, and this case remanded to the district court with instructions to dismiss
the action.
